Following an incident in the early morning of Jan. 29, Marshfield citizen Lane Barger faces two Class E Felonies of property damage and unlawful use of a weapon. He also faces an unclassified felony of armed criminal action and a Class B Felony of assault in the 1st degree.
The following information is from a probable cause statement from an officer of the Marshfield Police Department after multiple officers were dispatched to a house following a shots fired call.
Officers arrived on the scene and spoke to a witness who explained that Barger had been upset with a roommate the day before and had started drinking. After which, Barger stepped outside and smashed the windshield of the roommate’s vehicle. That night the roommate came home, and the two had an altercation resulting in a gun that Barger owned going off. No one was harmed during the incident.
As of the writing of this article, Barger is out on a $100,000 surety bond and will return to court Tuesday, Feb. 28 with a public defender.
Each felony carries its own range of punishment. Both Class E Felonies carry one to four years in the Missouri Department of Corrections, a special one-year term in county jail, a fine up to 10,000 dollars, or a combination of a fine and prison time.
For the felony of Armed Criminal Action, Barger could face three to fifteen years in the Missouri Department of Corrections. And for a Class B Felony, it is five to fifteen years in the Missouri DOC. Parole is possible so long as 85 percent of the sentence is served.
