You, and each of you, are hereby notified that the Petitioner has commenced an action against you in the Circuit Court of Christian County, Missouri, to ascertain and determine the title to the following described land situated in Christian County, Missouri, to wit:
ALL THAT PART OF THE SOUTHWEST QUARTER (SW 1/4) OF THE NORTHWEST QUARTER (NW1/4) OF SECTION TWELVE (12), TOWNSHIP TWENTY-SEVEN (27), RANGE TWENTY (20), CHRISTIAN COUNTY, MISSOURI, LYING EAST OF PUBLIC ROAD BEING 17 ACRES MORE OR LESS. BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
FROM THE WEST QUARTER CORNER OF SAID SECTION 12; THENCE EAST ALONG THE SOUTH LINE OF SAID SOUTHWEST QUARTER (SW 1/4) NORTHWEST QUARTER (NW 1/4) 654.9 FEET TO THE POINT OF BEGINNING (P.O.B.) SAID POINT BEING WHERE THE EASTERLY RIGHT-OF-WAY LINE OF SAID PUBLIC ROAD INTERSECTS THE SOUTH LINE OF SAID SOUTHWEST QUARTER (SW 1/4) NORTHWEST QUARTER (NW 1/4), THENCE CONTINUING EAST 707.6 FEET TO THE EAST LINE OF SAID SOUTHWEST QUARTER (SW 1/4) NORTHWEST QUARTER (NW 1/4) THENCE NORTH ALONG SAID EAST LINE 200.0 FEET, THENCE N 71 DEGREES 50' W 633.0' TO A POINT ON THE EASTERLY RIGHT-OF-WAY LINE OF SAID PUBLIC ROAD, THENCE S 14 DEGREES 57' W 411.3 FEET TO THE POINT OF BEGINNING. THIS PARCEL CONTAINS 4.60 ACRES MORE OR LESS. THE SOUTH CENTERLINE OF THE SOUTHWEST QUARTER (SW 1/4) NORTHWEST QUARTER (NW 1/4) OF SECTION 12-27-20 WAS ASSUMED TO BE N 90 DEGREES E. ALSO A 1/3 INTEREST IN A CERTAIN WATER WELL AGREEMENT RECORDED IN THE CHRISTIAN COUNTY RECORDER'S OFFICE IN BOOK 232, AT PAGE 18.
Petitioner also alleges in his Petition, that Respondents, STEVEN V. JOHNSON, CAROLYN S. JOHNSON, and JOHN DOE, and any unknown personal representative, successors, heirs, devisees, grantees, and assigns are either living and are nonresidents of the State of Missouri, and that their addresses are unknown to Petitioner, or that the said Respondents, or any of them, have departed this life; and Petitioner believes and avers that the one or the other is true, and that it be the one or the other; and verily believe that if said Respondents, or any of them, be now dead, that there are other persons interested in the subject matter of their petition and in the lands above described, whose names Petitioner cannot insert because the same is unknown; that such unknown persons derive their claims as consorts, heirs, devisees, donees, alienees, successors, the immediate, mesne and remote, the voluntary and involuntary grantees of said above named Respondents and that his interests and claims, if any, are identical with those of the above named Respondents.
You, and each of you, are further notified that the object and general nature of this cause of action is to quiet the title to the above-described land, finally settling all the rights of all the parties herein, Petitioner and Respondents, and the unknown person described as Respondents herein, and to forever. preclude the Respondents and unknown persons described herein as Respondents from hereafter setting up any claim to said land or any part thereof.
You, and each of you, are further notified that the name and address of the attorney for the Petitioner is SCOTT HALL, 210 W. Oklahoma St., of Branson, Missouri.
You are further notified that unless you be and appear in the Circuit Court of Christian County, Missouri, in the City of Ozark, Christian County, Missouri, and file an answer or otherwise defend said action within forty-five (45) days from the 10th day of April, 2024, the date of the first publication of this order, the allegations in Petitioner's Petition will be taken as confessed by you and judgment rendered accordingly.
It is further ordered that a copy of this Order of Publication be printed and published in the Christian County Headliner News, a weekly newspaper of general circulation, printed and published in Christian County, Missouri, as provided by law.
